1. Agreement to Terms
By engaging the services of APEX Structural Inspections Services ("we", "us", or "our"), you agree to be bound by these Terms of Service. These terms apply to all structural inspections, reports, and consulting services provided by us.
2. Scope of Services
Our services are limited to structural engineering assessments as defined in the specific quote or engagement letter provided to the client. Unless explicitly stated, inspections are visual in nature and do not involve invasive testing or the removal of building materials.
3. Fees and Payment
Fees are as quoted and are inclusive of GST unless stated otherwise. Payment is required in full upon delivery of the final report unless alternative credit terms have been agreed upon in writing. We reserve the right to withhold reports until payment is received.
4. Limitation of Liability
To the maximum extent permitted by law, including the Australian Consumer Law:
- Our liability for any structural defect not identified in a visual inspection is limited to the cost of the services provided.
- We are not liable for defects that were concealed, inaccessible, or obstructed at the time of inspection.
- Our reports are for the sole use of the client named in the report and may not be relied upon by third parties without our express written consent.
5. Cancellations
Cancellations made within 24 hours of a scheduled inspection may incur a cancellation fee. We reserve the right to reschedule inspections due to inclement weather or unsafe site conditions.
6. Intellectual Property
All reports, sketches, and documentation provided remain the intellectual property of APEX Structural Inspections Services. Clients are granted a non-exclusive license to use these documents for the specific purpose for which they were generated.
7. Governing Law
These terms are governed by the laws of Western Australia. Any disputes arising from our services will be subject to the exclusive jurisdiction of the courts of Western Australia.
